The judge in the case said Fortnite's eviction by Apple was a "self-inflicted wound". Epic Games on Monday failed to convince a US judge to make Apple put its hit title Fortnite back in the tech giant's App Store, while their legal battle heads for a possible trial next year. The two firms are fighting over whether Apple's tight control of the App Store , and its 30 percent cut of revenue, counts as monopolistic behavior. The judge said she didn't expect a trial over the dispute to start until July of next year, at the earliest, given her calendar. She advised Apple and Epic to request a jury to hear the case and is to issue a written explaining Monday's ruling. Apple does not allow users of its popular devices to download apps from anywhere but its App Store, and developers have to use Apple's payment system which takes its cut. The legal battle comes as Apple puts priority on selling digital content and subscription services to the one billion-plus people around the world using devices powered by its iOS mobile operating software. Major app developers including Epic and streaming music giant Spotify recently formed a coalition to press for new terms with the major online marketplaces operated by Apple and Google. Google runs a Play Store for apps tailored for devices powered by its Android software and also takes a commission, but people are free to get apps from other online venues.

With the meteoric success that Fortnite has seen in recent years , it's no wonder that numerous videos of incredible wins have popped up all over YouTube. Strategies for achieving victory, unreal winning streaks, and moments of sheer dumb luck have been dominating YouTube since the game was first released. But with the endless parade of those willing to show off their prowess in the world of the battle royale, there are also those people who have failed in the most epic ways possible. Whether these gamers are embracing their fail and sharing it with the world, or if their gameplay was clipped by someone else and uploaded without their knowledge, these less-than-winning videos are often more enjoyable to watch than the expert Fortnite players. With everything from accidental suicide to instant karma, here are some of the most epic fails in Fortnite. Gamer SoCloseToToast learned pretty quickly that fate can be a fickle mistress. But he also showed that he could be a good sport about it by uploading the video of his life lesson. As anyone celebrating a victory might do, he laughed at his victim's poor luck, looking very satisfied with himself and his ability to dominate in the arena. But as many already know, and SoCloseToToast was about to learn, karma isn't one to be trifled with.

Epic Games has, for the time being, lost its legal battle with Apple, in which the developer sought a preliminary injunction that would prevent the Cupertino company from continuing to ban Fortnite from the App Store, in its current state that sidesteps royalty payments from in-game purchases. However, Unreal Engine can remain. It is more of an Epic loss than an Epic win, so to speak, because Fortnite is the bigger play and the cause for this legal showdown between Epic Games and Apple. It started when Epic Games suddenly decided it was tired of paying Apple a 30 percent royalty for in-game purchases, the same rate that all developers in the App Store are contractually obligated to pay.
